Welcome to shop.redstatebbq.com (the "Site"), operated by Red State BBQ ("we," "us," "our"). These Terms of Service ("Terms") govern your access to and use of the Site, including browsing, creating an account, and purchasing products such as bottled sauces, merchandise, and limited-edition drops.
By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on the Site. By placing an order, you represent that you meet this requirement and that any information you provide is accurate and complete.
2. Products and Availability
- We make reasonable efforts to display product descriptions, images, and pricing accurately, but we do not warrant that product descriptions or other content are error-free.
- Some products, such as the 1776 Independence Blend or other limited-edition items, are offered in limited quantities on a first-come, first-served basis. We do not guarantee availability, restock, or the ability to fulfill your order, even after checkout, and reserve the right to cancel orders for items that sell out or are listed in error.
- We reserve the right to limit quantities purchased per person, per household, or per order.
- We reserve the right to discontinue any product at any time.
3. Pricing and Payment
- All prices are listed in U.S. dollars and are subject to change without notice.
- Applicable sales tax and shipping fees will be calculated and displayed at checkout.
- Payment is processed through our third-party payment processor. By providing payment information, you represent that you are authorized to use the payment method provided.
- We reserve the right to refuse or cancel any order, including for reasons such as suspected fraud, unauthorized transactions, pricing errors, or errors in product or availability information.
4. Orders and Order Acceptance
Your receipt of an order confirmation does not constitute our acceptance of your order, nor does it constitute confirmation of an offer to sell. We reserve the right to accept or decline your order for any reason after receipt of your order confirmation, including if the product is unavailable, there is an error in pricing or product description, or we suspect fraudulent activity.
5. Shipping and Delivery
- We currently ship to addresses within the United States. It is your responsibility to ensure your shipping information is accurate.
- Shipping times and costs will be provided at checkout and are estimates only; we are not responsible for carrier delays.
- Risk of loss and title to products pass to you upon our delivery to the shipping carrier.
- Perishable and food items are packaged for shipping durability, but we are not responsible for spoilage caused by carrier delays outside our control.
6. Returns, Refunds, and Cancellations
- Due to the nature of our food products, all sauce and food-item sales are final unless the item arrives damaged, defective, or incorrect.
- To report a damaged, defective, or incorrect order, contact us within 7 days of delivery at info@redstatebbq.com with your order number and photos of the issue.
- Non-food merchandise (e.g., apparel, drinkware, accessories) may be returned within 30 days of delivery in unused, original condition with tags/packaging intact. Buyer is responsible for return shipping unless the item was defective or shipped in error.
- Approved refunds will be issued to the original payment method within 5–10 business days of us receiving the returned item (where applicable).
- Limited-edition and one-time drop items (such as the 1776 Independence Blend) are final sale and not eligible for return or exchange except in cases of damage in transit.
7. Account Registration
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
8. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Site, other accounts, or our systems
- Use bots, scrapers, or automated means to purchase limited-edition items in a way that circumvents purchase limits

10. User-Submitted Content
If you submit reviews, comments, photos, or other content to us (e.g., via social media tags or contest entries), you grant Red State BBQ a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute that content in connection with our business and marketing, without compensation to you.
